By accessing or using the DiRECT2 website at direct2.app ("the Site"), you agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Site. We reserve the right to modify these terms at any time, and your continued use of the Site constitutes acceptance of any modifications.
2. Description of Service
DiRECT2 is an AI research startup that provides educational content related to evidence-based diabetes remission, inspired by the DiRECT clinical trial published in The Lancet (2018). Our current service includes a free downloadable 1-page eating plan and related educational email communications. DiRECT2 does not provide medical advice, diagnosis, or treatment. 3. User Eligibility
You must be at least 18 years old to use our services. By using the Site and submitting your email address, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into these Terms.
4. Account and Email Registration
When you provide your email address to receive our eating plan, you agree to: provide a valid and accurate email address; receive the requested eating plan and related follow-up communications; and understand that you may unsubscribe from communications at any time via the unsubscribe link included in every email we send.
5. Intellectual Property
All content on the Site, including but not limited to text, graphics, logos, images, the eating plan PDF, and software, is the property of DiRECT2 or its content suppliers and is protected by United States and international copyright laws. The DiRECT2 name, logo, and brand gradient are trademarks of DiRECT2. You may download and use the eating plan for personal, non-commercial purposes only. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any content from the Site without prior written consent.
6. Prohibited Uses
You agree not to: use the Site for any unlawful purpose; submit false or misleading information; attempt to gain unauthorized access to our systems or databases; interfere with or disrupt the Site or its servers; use automated tools (bots, scrapers, etc.) to access the Site without our written permission; redistribute, resell, or commercially exploit our content; or use the Site in any way that could damage, disable, or impair its functionality.
7. Disclaimer of Warranties
The Site and all content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. We make no warranties regarding the accuracy, reliability, or completeness of any content, including the eating plan. Your use of the Site is at your own risk.
8. Limitation of Liability
To the fullest extent permitted by applicable law, DiRECT2, its founders, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from: your access to or use of (or inability to access or use) the Site; any content obtained from the Site; or unauthorized access, use, or alteration of your information. In no event shall our total liability exceed one hundred dollars ($100).
9. Indemnification
You agree to indemnify and hold harmless DiRECT2 and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your access to or use of the Site or your violation of these Terms.
10. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by DiRECT2. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. You acknowledge and agree that DiRECT2 shall not be responsible or liable for any damage or loss caused by the use of any such third-party content or services.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within the United States.
12. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
